PourLaVictoire.com Rewards Program Terms and Conditions

PourLaVictoire.com wants to reward you for your loyalty. For every 100 Reward Points (“Points”) points you accumulate, the Pour La Victoire Rewards Program (“Rewards Program”) will give you FIVE DOLLARS to spend on our website. The Pour La Victoire Rewards Program (“Rewards Program”) is designed to reward its loyal customers for partnering with us.

Our Rewards Program is as simple as it sounds. Once you’ve earned points you will be able to use those points to pay for future purchases at PourLaVictoire.com. We are proud to offer this program with the launch of our new Pour La Victoire online store.

Points and Values

     1. Sign up to become a member on PourLaVictoire.com and receive 25 points
. 2. Make a purchase on PourLaVictoire.com and receive 1 point for every dollar spent on our products.  3. Refer a friend to become a member on PourLaVictoire.com and receive 25 points
    4. Get a friend to order on PourLaVictoire.com and receive 50 points.

Eligible Participants

In order to participate in the Rewards Program, you must meet the following requirements:

1. Must be a registered member of PourLaVictoire.com, a legal U.S . resident, 18 years or older with a U.S. address associated with your PourLaVictoire.com account.
 
2. Accepts these Terms and Conditions and not have opted out of the program. 3. Be a member in good standing with a current account.

4. Agree to receive email confirmation of your registration and updates on your membership status in the Rewards Program from PourLaVictoire.com to a valid email address associated with the creation of your membership account.

5. Has not been previously terminated from the Rewards Program program by PourLaVictoire.com.

6. Not be an affiliate, subsidiary, an employee or spouse of an employee affiliate of PourLaVictoire.com and PLV Studio Inc. 7. Not be a commercial customer or any other person, company or entity purchasing items for resale.

Qualifying Purchases

There are no restrictions as to what items may be purchased using your rewards points on PourLaVictoire.com.  This includes sale items and items used with a coupon or discount code.

Reward points will be awarded for the final value of the products purchased, excluding taxes, shipping costs, promotional code value, refunds, free items, past purchases and non shipped, undeliverable or returned items.

A minimum balance of 100 points is required before you can redeem your rewards points on a purchase.

There is no minimum purchase amount required to redeem your points.

The maximum amount of points you can redeem at once is 30,000 points. 

The entire purchase for which even a any portion was paid for by reward points is not eligible to earn rewards Reward Points.

How does the Reward Program work?

Once you successfully activate your PourLaVictoire.com account and begin earning points, they will be approved (within 48 hours) and your Points will appear in the Reward section on your “My Account” page.

Click on “Reward Points” to check your reward pPoint balance. You will be able to see your total Point balance, the amount of any purchases which were used to calculate that equaled any rewards Points, the points you earned, the source of the reason you earned points, and the date you earned and used your reward points.

Reward points do not expire. However, the Reward Program is subject to change. You must log in to your account in order to view the status of your Reward Points.

Reward points may only be earned on one PourLaVictoire.com online account per Eligible Participant, regardless of the number of accounts used by the Eligible Participant.

Reward points are only tied to only one account on PourLaVictoire.com and cannot be transferred to any other account.

Reward points earned on PourLaVictoire.com have no face value and may not be redeemed for cash.

PourLaVictoire.com reserves the right to fix correct any processing or calculating errors discovered and make such adjustments to an account holder’s Reward Points balance as necessary, without notice to the account holder.

Redeeming your Reward Points

An Eligible Participant may redeem their reward points in accordance with the following requirements:

Reward points may only be redeemed on PourLaVictoire.com.

Reward points are not transferrable and have no value.

Reward points cannot be used for prior purchases.

Unredeemed reward points are forfeited if the Eligible Participant opts out of the Rewards Program.

If the user’s PourLaVictoire.com account is terminated or suspended, the unredeemed points are forfeited.

If the purchase is returned or cancelled, the points earned on the purchase are deducted from the account.

There are no fees associated with redemption of Rewards Points.


How to Redeem Your Reward Points

Once you have accumulated at least 100 reward points, you can use your reward points towards purchases made on PourLaVictiore.com. To redeem your reward points, finalize your purchase and then proceed to the checkout process.  On the payment selection page, you will be given the option to use your reward points towards your purchase. Please note that if the balance of your reward points does not cover your purchase, you must still choose another payment method to cover the remaining balance of your purchase. As you continue the checkout procedure and reach the confirmation page, the value of the Points redeemed will have been credited towards your order. Once you confirm your order, your reward Points account will be updated and the Points used will be deducted from your balance.

Modification or Termination

PourLaVictoire.com reserves the right to modify or terminate this program at any time by
 
1. Posting amended terms and conditions on this page; or

2. Posting a termination notice in the Rewards Section of a user account; or

3. Sending an email to the account used to register for the Rewards Program.

If any modification is unacceptable to you, your only recourse is to opt out of the Rewards Program.  If PourLaVictoire.com, in its sole discretion, believes an Eligible Participant of the Rewards Program has used or is using multiple accounts in order to circumvent or undermine these Terms and Conditions, PourLaVictoire.com reserves the right to terminate the Eligible Participant from the program.  PourLaVictoire.com  reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys’ fees and court costs.

This program is void where prohibited by and subject to US law

Limitation of Liability. PourLaVictoire.com SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, CAUSES OF ACTION, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM THE REWARD PROGRAM.  THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL  LOSS OR DAMAGES OF ANY KIND RESULTING FROM THE REWARD PROGRAM, AS ALLOWED BY LAW, INCLUDING, BUT NOT LIMITED TO, COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS OF THE PROGRAM AGREE THAT POURLAVICTOIRE.COM HAS NOT MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE, IN FACT OR IN LAW, RELATIVE TO THE REWARDS PROGRAM. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, POURLAVICTOIRE.COM DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO WWW.POURLAVICTOIRE.COM, AND POURLAVICTOIRE.COM SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED TO THE REWARDS PROGRAM. THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS.
 
PourLaVictoire.com is not responsible for any printing or typographical error in material related to the Rewards Program; for stolen, lost, late, misdirected items or correspondence; or for transactions and/or correspondence that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any website associated with the Rewards Program, or process any transaction thereon.  If in PourLaVictoire.com’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Rewards Program, or if any computer virus, bugs malware, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Rewards Program, PourLaVictoires.com reserves the right at its sole discretion to disqualify any individual connected therewith, to modify or suspend the Rewards Program, or to terminate the Rewards Program.  PourLaVictoire.com’s interpretation and application of any rule and condition of this Rewards Program shall be final.  PourLaVictoire.com reserves the right to cancel, amend or revoke any Rewards Program at any time due to reasonable business consideration or circumstances beyond its control.  Any attempt by an Eligible Participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Rewards Program is a violation of criminal and civil laws.  Should such an attempt be made, PourLaVictoire.com reserves the right to revoke any reward points and seek damages and other remedies from any such person to the fullest extent permitted by law.  Any attempt by an individual to access any website associated with the Rewards Program via a bot script or other brute force attack or any other unauthorized means will result in the affiliated IP address becoming ineligible.  Use of automated devices or programs to access and to redeem the Rewards Points Program is prohibited. 

The waiver by PourLaVictoire.com of a breach of any provision of this Agreement by an Eligible Participant or other individual shall not operate or be construed as a waiver of any other or subsequent or preceding breach by an Eligible Participant or other individual.  No waiver by PourLaVictoire.com of any right under the Program shall be construed as a waiver of any other right. PourLaVictoire.com shall not be required to give notice to enforce strict adherence to all terms of the Rewards Program.

Governing Law.  For purchases, Rewards Points earnings and redemptions made at www.PourLaVictoire.com these Terms and Conditions and the Rewards Program will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the state of New York.  Any cause of action, claim or dispute arising under or relating to these Terms and Conditions shall be brought exclusively in a court located in the State of New York, County of New York.
